If you have an address in England or Wales, you can use MCOL. A lot of different types of claims can be made via MCOL, as long as the amount being claimed for is less than £100,000. You can only use MCOL as a single claimant, and for claims against no more than two people or businesses.

 

  • What Do You Need to Make a MCOL?

 

To make a MCOL, you need to have a valid debit or credit card to pay the court fees, an address in England or Wales, an email address and access to the internet. You must be able to have documentation proving that you are owed money, how much and by who.

 

  • Can Everyone Use MCOL?

 

To make a MCOL, you must be over the age of 18, but not everyone can use the service. You can’t use MCOL if you’re eligible for legal aid, if you’re making a claim for compensation for an accident or injury, or if you’re intending to issue a joint warrant of control.

 

  • Can a MCOL Be Made Against Anyone?

 

You can’t make a MCOL against everyone. For example, you won’t be able to use MCOL if you’re making a claim against someone under the age of 18, someone who lacks the mental capacity to make their own decisions, or if the claim is against a government department, such as the DVLA.

 

  • How Much Does It Cost to Make a MCOL?

 

There’s a cost that comes with making a MCOL, ranging from £35 to £10,000 depending on how much you’re claiming for. You may be able to claim the fees back if you win the case.

 

  • Can I Use MCOL Without a Lawyer?

 

Yes, MCOL has been designed to be a simple and straightforward process, and the system will guide you through every step. You don’t need to have hired a lawyer or solicitor to make a Money Claim Online.
